Notice Requirement for the Families First Coronavirus Response Act

On March 18, 2020, Congress passed the Families First Coronavirus Response Act (FFCRA). The provisions of this Act include providing paid emergency leave and expanded family and medical leave for school district employees who meet the applicable criteria for eligibility. The paid leave provisions of the FFCRA are effective April 1, 2020, and apply to leave taken from April 1, 2020 until December 31, 2020. Covered employers, which includes all public school districts, are required to post a notice of the FFCRA requirements in a conspicuous place on district premises. That notice can be found here.

Due to the school closure, and most employees now working remotely, a district may satisfy the posting requirement in one of several ways – e-mailing the notice to all employees, sending the notice by paper mail, or by posting the notice on the district’s website. This notice must be posted or distributed by April 1, 2020. If you have questions about meeting these notice requirements or about the application of the FFCRA, your Walsh Gallegos attorneys are here to help.
